1. About Hello Gravel
Hello Gravel Inc. (“Hello Gravel,” “we,” “us,” or “our”) is a marketplace that connects customers with independent suppliers and haulers for bulk landscaping materials, including gravel, sand, topsoil, mulch, and similar products (“Materials”), delivered by dump truck. We are headquartered in New Orleans, Louisiana.
2. Acceptance of Terms
By accessing or using hellogravel.com (the “Site”) or placing an order through our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our Services.
You must be at least 18 years old to place an order. By placing an order, you represent that you are 18 or older and have the legal authority to enter into this agreement.
3. Our Marketplace Model
Hello Gravel is a marketplace platform — not a materials producer, not a trucking company, and not a general contractor. We connect customers with independently operated local suppliers (who provide the Materials) and haulers (who transport and deliver them).
When you place an order through Hello Gravel:
- Hello Gravel processes your order, collects payment, coordinates fulfillment, and provides customer support.
- The supplier is an independent third party responsible for sourcing and providing the Materials.
- The hauler is an independent third party responsible for transporting and delivering the Materials to your location.
Suppliers and haulers are independent contractors, not employees or agents of Hello Gravel. Hello Gravel does not control the day-to-day operations of suppliers or haulers, and is not responsible for their acts or omissions except as expressly stated in these Terms.
4. Orders and Pricing
Pricing: Prices displayed on our Site are estimates based on material type, quantity, and delivery location. Final pricing may vary based on market conditions, supplier availability, and actual delivery distance. If pricing changes materially after you place an order, we will contact you before proceeding.
Order confirmation: Placing an order does not guarantee fulfillment. We will confirm your order by email once a supplier and hauler have been assigned. Availability varies by location.
Quantity: Bulk materials are sold by the ton or cubic yard. Quantities are approximate. Natural variation in material density means actual delivered quantity may vary slightly from what was ordered.
Service area: We operate in select markets across the United States. We cannot guarantee availability in all areas.
5. Delivery
Delivery windows: We will provide an estimated delivery window. Delivery times are estimates and not guarantees. Delays may occur due to weather, traffic, equipment issues, supplier availability, or other factors outside our control.
Access: You are responsible for ensuring that the delivery location is accessible to a standard dump truck. This includes adequate driveway width, clearance, surface condition, and weight capacity. If a hauler cannot safely access your property, delivery may not be completed and you may be charged a trip fee.
Dump and go: Unless otherwise agreed in writing, deliveries are “dump and go” — the hauler will deposit Materials at the agreed drop point and leave. Spreading, placement, or installation of Materials is not included.
Drop location: You must designate a suitable drop location before delivery. Once Materials are dumped, Hello Gravel and the hauler are not responsible for relocating them. If you are not present at delivery, you authorize us to proceed with delivery to the agreed drop location.
6. Property Access and Delivery Conditions
By placing an order, you represent and warrant that:
- You own the property or have explicit authorization from the property owner to accept a bulk material delivery
- The access route to the designated drop location can safely support a loaded dump truck (typically 60,000–80,000 lbs gross vehicle weight)
- There are no overhead obstructions, buried utilities, irrigation lines, or other hazards at or near the drop location that have not been disclosed to us
- You have checked with your local utility notification service (e.g., 811 in the United States) if the drop location is near any underground utilities
You are responsible for providing accurate site access information. Hello Gravel and the hauler rely on this information to plan the delivery.
7. Property Damage
You acknowledge and accept the following:
Dump truck deliveries involve heavy vehicles and large quantities of material. There is an inherent risk of property damage, including but not limited to damage to driveways, pavement, curbs, lawns, landscaping, irrigation systems, underground utilities, fences, structures, and other property.
Hello Gravel’s liability for property damage is limited as follows:
- Hello Gravel is a marketplace and is not the hauler. Haulers are independent contractors. Hello Gravel is not liable for property damage caused by the acts or omissions of haulers during delivery.
- To the extent Hello Gravel has any liability for property damage, that liability is limited to the lesser of (a) the actual cost of repair or (b) the total amount you paid for the applicable order.
- Hello Gravel is not liable for damage caused by subsurface conditions (such as buried utilities, weak pavement bases, or sinkholes), drainage issues, or conditions you failed to disclose.
- Hello Gravel is not liable for indirect, incidental, special, consequential, or punitive damages arising from delivery, including loss of use of your property.
If damage occurs during delivery: Contact us at support@hellogravel.com within 48 hours and provide photographs and a description of the damage. We will work with you and the hauler in good faith to address the situation. Claims submitted more than 7 days after delivery may not be honored.
We strongly recommend:
- Photographing your driveway and drop area before delivery
- Ensuring your homeowner’s or property insurance is current
- Consulting with your hauler or Hello Gravel support before delivery if you have concerns about access
8. Returns, Cancellations, and Refunds
Cancellations: You may cancel your order without penalty up to 24 hours before the scheduled delivery window. Cancellations within 24 hours of the scheduled delivery may be subject to a cancellation fee. Once delivery is in progress, the order cannot be cancelled.
Returns: Bulk landscaping materials are non-returnable once delivered. If you ordered the wrong product or quantity, contact us and we will do our best to help you place a follow-up order.
Refunds: If we are unable to fulfill your order due to supplier or hauler unavailability, you will receive a full refund. Refunds for other reasons are evaluated on a case-by-case basis. Contact support@hellogravel.com within 7 days of your delivery date.
9. Product Information
We make reasonable efforts to display accurate product descriptions, photos, and specifications. However:
- Colors, textures, and appearance of natural materials vary by source location, season, and batch. What you see on screen may not exactly match what is delivered.
- Material names (e.g., “pea gravel,” “#57 stone”) are industry-common terms and may vary slightly by region and supplier.
- Hello Gravel does not warrant that materials are suitable for any particular use. You are responsible for determining whether a material is appropriate for your project.
10. Payment
Payment is due at the time of order. We accept major credit and debit cards and, where available, financing through Affirm. By providing payment information, you authorize Hello Gravel to charge the amount shown at checkout.
If your payment is declined or charged back, your order will be cancelled and you may be barred from placing future orders until the balance is resolved.
11. Prohibited Uses
You agree not to use our Services to:
- Violate any applicable law or regulation
- Submit false or misleading information
- Interfere with or disrupt our Services or servers
- Attempt to gain unauthorized access to any portion of our Services
- Scrape, harvest, or collect data from our Site without our written permission
- Use our Services for any commercial resale purpose without our prior written consent
12. Intellectual Property
All content on hellogravel.com, including text, graphics, logos, product descriptions, and software, is the property of Hello Gravel Inc. or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on our Site without our prior written permission.
13. Disclaimer of Warranties
OUR SERVICES AND ALL MATERIALS, INFORMATION, AND CONTENT PROVIDED THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HELLO GRAVEL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY PRODUCT INFORMATION, PRICING, OR AVAILABILITY.
BECAUSE HAULERS AND SUPPLIERS ARE INDEPENDENT CONTRACTORS, HELLO GRAVEL MAKES NO WARRANTIES REGARDING THEIR PERFORMANCE, TIMELINESS, OR THE CONDITION OF MATERIALS THEY SOURCE OR DELIVER.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- HELLO GRAVEL’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.
- HELLO GRAVEL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, PROPERTY DAMAGE BEYOND THE LIMITS STATED IN SECTION 7, OR PERSONAL INJURY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- HELLO GRAVEL SHALL NOT BE LIABLE FOR THE ACTS OR OMISSIONS OF INDEPENDENT SUPPLIERS OR HAULERS, INCLUDING ANY PROPERTY DAMAGE, PERSONAL INJURY, OR OTHER LOSS CAUSED BY THEIR DELIVERY OPERATIONS.
Some states do not allow limitations on implied warranties or exclusion of certain damages, so some of the above limitations may not apply to you.
15. Indemnification
You agree to indemnify, defend, and hold harmless Hello Gravel Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of our Services
- Your breach of these Terms
- Your provision of inaccurate site access or property information
- Any property damage or personal injury occurring on your property during or after delivery
- Your violation of any applicable law or the rights of any third party
16. Dispute Resolution and Arbitration
Informal resolution first: If you have a dispute with Hello Gravel, please contact us at support@hellogravel.com. Most disputes can be resolved quickly through our support team.
Binding arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in New Orleans, Louisiana, or by telephone or videoconference.
No class actions: You and Hello Gravel agree that all claims must be brought in your individual capacity and not as a plaintiff or class member in any class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.
Small claims exception: Either party may bring an eligible claim in small claims court instead of arbitration.
Opt-out: You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing support@hellogravel.com with the subject line “Arbitration Opt-Out.” If you opt out, disputes will be resolved in courts located in Orleans Parish, Louisiana.
17. Governing Law
These Terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws provisions. Subject to Section 16, you consent to the exclusive jurisdiction of state and federal courts located in Orleans Parish, Louisiana.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
